B. PRIVACY STATEMENT
- Farmdesk is committed to protecting your personal data and your privacy. Your personal data will be processed in accordance with the legislation in force and this Privacy Statement.
- This privacy statement informs you about what types of personal data are processed and stored by Farmdesk and how they are handled within the organization. Farmdesk collects personal data through its website, applications, services and other means linked to information and communication technology, including emails, organization of competitions, .... This collection of ways in which Farmdesk interacts with its customers is further referred to as "the Platform." The Privacy Statement also describes how personal data is processed and shared with third parties. It also provides insight into the various measures implemented by Farmdesk in order to ensure the security and confidentiality of the personal data collected.
- You have the opportunity to become familiar with this Privacy Statement during as well as after the registration process on the Platform. The Privacy Statement can always be found on the Farmdesk website. The voluntary submission of personal data by you as a user to Farmdesk implies your agreement to this Privacy Statement, where clearly indicated.
- Farmdesk should be considered the data controller of the personal data and will act in accordance with applicable privacy laws, including the General Data Protection Regulation (Regulation (EU) 2016/679 of April 27, 2016).

- In a changing world where technology is constantly evolving, we remind you that this Privacy Statement may undergo changes. Therefore, we invite you to consult the latest online version of it regularly, and we will inform you the Platform or through the other usual communication channels (e.g., by e-mail) of any update to the Privacy Statement.
- Please note that the Platform may contain hyperlinks leading to other digital platforms or Internet resources, which, by means of cookies or other technological means, may collect personal data. Farmdesk is in no way responsible for these websites and Internet resources as they are beyond the actual control of Farmdesk. Nor is Farmdesk responsible for the collection, use and dissemination of your data by the aforementioned third parties. Farmdesk encourages you to review the Privacy Statement of these other websites and Internet resources to understand how these third parties collect and use your personal data.
WHAT PERSONAL DATA DOES FARMDESK PROCESS?
- Your personal data are data that can identify you directly (data such as your last name and first name can identify you immediately) or indirectly (data such as your zip code or phone number can identify you indirectly).
- In case of interactions with you, we may collect different data according to the respective services/types:
- basic information such as your name, gender, date of birth and job title;
- contact information such as your address, e-mail address and phone number;
- Information about your company such as UBN/Sanitel number, company address, VAT number;
- Information you share with us when completing surveys or journals;
- Information that you provide Farmdesk to allow us to send you a prize or provide it via any form.
- Login credentials with external data providers;
WHAT DATA DOES FARMDESK PROCESS?
Specific data Farmdesk only collects data necessary for the proper functioning of its products. A (non-exhaustive) overview of possible data types:
- Dairy data: per tank milk collection the number of liters/kilograms, fat, protein, lactose, urea contents, cell count, germ count, date of delivery
- Animal data: list of number of animals on the farm, birth dates, birth history
- Milk control dates: liters, fat and protein content per animal and by date
- Plot data: number of plots, location, crop history
- Feed data: feed values of own feed, feed intakes
Farmdesk does not share these data with any external party. Upon termination of the cooperation, Farmdesk anonymizes all data in an irreversible manner, so that the data can no longer be linked to a specific person. In this way, Farmdesk can still perform anonymous analyses on the data for statistical and scientific purposes.
E-marketing
Upon creation of your user account (both for a commercial license and for free demo versions), you may expressly consent via an opt-in checkbox to receive communications from Farmdesk. If you accept this, Farmdesk will send you electronic newsletters that contain information of a commercial nature or contact you by phone about new products and services, promotions and benefits, the possibility to participate in promotions/competitions, and so on. If you do not wish to receive our newsletters, you may withdraw your consent at any time by notifying info@farmdesk.eu.
Participation in actions and competitions
Your personal data will be processed in the context of the follow-up and organization of actions/competitions in which you would participate through our Platform. Without the processing of the personal data in question, Farmdesk is not able to provide its services in the context of the execution of the action and/or contest. Farmdesk's legitimate interest is used as the permissible ground for processing your personal data. The use of your personal data helps Farmdesk improve your user experience, analyze data, create marketing profiles and organize market studies. We reassure you that this profiling is not intended to make automated decisions that have negative consequences for you.
YOUR RIGHTS
In accordance with the law, you have a right to access, rectify, delete and transfer your data. In certain cases, you also have the right to oppose or limit their processing. These rights are free of charge and may be exercised at any time.
General rights
- Right of Access: You have the right to access and receive a copy of the data relating to you.
- Right of correction: We take all reasonable steps to ensure that the data we hold is up to date and to delete any data that is found to be inaccurate or no longer necessary for processing. We encourage you to regularly open your account (if applicable) and review your data to ensure it is up-to-date. If you find that your data is incorrect or incomplete, you have the right to ask us to correct it. You can also modify all your Farmdesk account information by clicking to the profile page.
- Deletion right ("right to be forgotten"): In certain circumstances (for example, when you withdraw your consent or when the data processed is no longer necessary for the purpose of processing), you have the right to ask us to delete your personal data.
- Right to restrict processing: You can ask to restrict the processing of your data, after which your data will no longer be processed (but will be retained).
- Transferability right: You have the right to obtain that the data you have provided to us be transferred to you in a structured format or transferred directly from Farmdesk to another data controller.
- Right of opposition: If the processing of your data is based on a legitimate interest, you have the right to oppose it at any time. However, please note that in this case Farmdesk has the right to present you with its legitimate reasons justifying the continuation of the processing. You are always entitled to object, at any time and free of charge, to the processing of your data within the framework of direct marketing and no exceptions can be invoked against you by Farmdesk. This also includes the right to oppose profiling to the extent it is related to direct marketing.

Withdrawal of your consent
Where processing by Farmdesk is based on your consent, you may withdraw it at any time. This withdrawal will not call into question the legality of the processing of your data that occurred during the period before the withdrawal of your consent. In the context of direct marketing, this means that you may unsubscribe from Farmdesk's newsletters and other commercial communications at any time. You will then be put in "opt-out" mode. HOW ARE YOUR PERSONAL DATA SECURED?
Farmdesk has implemented appropriate safeguards to ensure the confidentiality and security of your personal data. Farmdesk has implemented appropriate technical and organizational measures to protect data against accidental or unlawful destruction or accidental loss, damage, alteration, disclosure or unauthorized access as well as all other forms of unlawful processing (including, but not limited to, unnecessary collection) or further processing.
Examples of such measures used by Farmdesk include IT security policies, secure servers and encryption of your sensitive personal data.
INTERNATIONAL TRANSFER OF DATA
Farmdesk will not transfer personal data to countries that do not have personal data protection laws equivalent to those in force within the European Economic Area.
HOW LONG DO WE KEEP YOUR DATA?
- When your personal data is collected based on your consent, we only use it until you withdraw your consent. From the time your consent is withdrawn, your personal data will be retained for the minimum time necessary to take the technical measures necessary to delete or anonymize your data.
- When your personal data is used to provide our services, such data will be kept for a reasonable period of time limited to the achievement of the purpose for which it was collected, including the minimum period of time necessary to take the technical measures necessary to delete or anonymize your data.
- In all cases, your personal data will be retained for the statutory limitation period or any other retention period that would be imposed by law.
- Anonymized company data is not deleted immediately, but after termination of the contract, is retained for a period of 100 years.

If you believe that your rights under the relevant legislation on the processing of personal data or under this document have been violated, you have the right to lodge a complaint about the processing of your data with the competent data protection authority.

HOW DO WE USE COOKIES?
When you use the Platform, we place "cookies" on your computer. Whether you have a Farmdesk account or are just a regular visitor to the Platform makes no difference. A "cookie" is a small file sent by our server to the hard drive of your computer, tablet or smartphone that identifies your browsing device and allows certain personal data to be collected.
We use different types of cookies:
- "strictly necessary cookies and functional cookies": These identify, for example, your country and the language you choose to use in order to make using the Platform as easy and as pleasant as possible for you.
- "performance cookies": With these, we collect visit statistics from our site to make it even more user-friendly and suggest content that better meets your needs;
- "commercial cookies": Allows us to present you with offers tailored to your areas of interest. However, this type of cookie will only be stored on your computer if you have specifically consented to it. - Farmdesk uses cookies to simplify, supplement and personalize your visits to the Platform. This section will give you a better understanding of how cookies work, why they are used and how to manage, reject or delete cookies.

The cookie allows the sites to record data related to your navigation in order to facilitate your visits and optimize your experience. What cookies does Farmdesk use and why?
Two types of cookies may be used by the Platform - "session cookies" and "persistent cookies." Session cookies are temporary cookies that remain on your device until you leave the Platform. Persistent cookies remain permanently or for a longer period of time until you delete them manually or they are automatically deleted by your device. How long a cookie stays on your device depends on the "lifetime" of the cookie in question or your browser settings.
Strictly necessary cookies
Thanks to these session cookies, it is possible to browse the Platform, use the functionalities of our sites and access secure areas. If the use of these cookies is disabled, certain parts of the Platform may not be accessible. For example, thanks to strictly necessary cookies, it is possible to fill out a form. It is also thanks to authentication cookies that you can access your personal account when you open a user session of the site via logins (on-board portal and mobile site).
These cookies do not identify you as an individual. If you do not accept these cookies, the performance of the Platform may be impacted.
Performance Cookies
Through the performance cookies, statistics are collected on the visiting behavior of visitors with the aim of making the sites more user-friendly and better adapting their content to the visitor.
